County Executive Ralph J. Eannace Jr. announced today that an arbitrator has ruled in the County's favor in the matter of the grievance filed by the Deputy Sheriff Police Benevolent Association.

The grievance issue was, did the County of Oneida violate the Collective Bargaining Agreement when it failed to pay step increases to PBA bargaining unit members on or about January 1, 1999? The arbitrator affirmed the County's position that the County was not required to pay step increases after the contract expired. In affirming the County's position the arbitrator stated, "the actions of the County clearly and unequivocally indicate that the County did not agree to the payment of increments during the pendency of a new collective bargaining agreement."

Eannace stated that the County is obviously pleased with the decision. The County has recently been unfairly criticized for not paying step movement to the PBA. The County has steadfastly maintained that it has not violated the contract and the arbitrator agreed. John F. Corcoran of Hancock and Estabrook represented the County in this matter.

Although pleased by the decision, Eannace said, " Our main goal is to settle the contract. We recognize that the PBA members are dedicated and committed employees and we respect the job they do. Our goal has always been to reach an agreement that is fair and equitable to all parties. "

Director of Labor Relations, John P. Talerico also said he was pleased by the arbitrator's decision. Talerico said that litigation has delayed the collective bargaining process. Talerico agreed with Eannace, "our main goal is to settle the contract for the reasons Ralph mentioned. The quickest way to settle matters like this is at the table. In fact, the County has made contract proposals that called for step movement in 1999."

The process is now in the fact-finding stage. Briefs have been submitted to the Fact-Finder with reply briefs to be exchanged no later than March 2, 2000.
